Solfeh and the Website

Welcome to Solfeh.com (the website, application or otherwise owned by or operated by Solfeh (“Website”), the online platform that offers financial assistance through Murabaha (Islamic Finance) (“Service”) within 24 hours, in a secured and confidential manner.

The use of, Service and contents provided on Solfeh are subject to these Terms & Conditions. These Terms & Conditions and all the other policies published on the Website constitute a legally binding agreement (“Agreement”) between You and Solfeh.

Solfeh is (The Interactive Solution for Individuals Finance), a limited liability company with its registered office at P.O. Box ( ), ( ) (Registration number (40563), Our legal representatives, administrators, successors-in-interest, permitted assigns and affiliates (“We”, “Us”, “Our” or “Solfeh”).

Therefore, any user or person who uses the Website or the Service in any manner whatsoever (“You”, “Your” or “User(s)”) is advised to carefully read these Terms & Conditions, as they include the conditions governing Your access to and use of the Website. If you continue to browse and use this Website, You are agreeing to comply with and be bound by the following Terms & Conditions. If You disagree with any part of these Terms & Conditions, please do not use this Website.

You are solely responsible for reviewing these Terms & Conditions from time to time, as the Terms & Conditions may be updated, changed, amended or modified by Solfeh at any time and at its discretion. In addition, Solfehreserves the right to take any measures deemed appropriate, at its sole discretion, including but not limited to, block, move, delete, modify, change any content or permanently delete any profile or content and/or report any activities to the competent authorities without a prior notice, or generally cease offering or deny access to the Website or any portion thereof, at any time for any reason without notice.

The Service

The Service is based on the concept of Murabaha, through which Solfeh will buy a certain amount of olive oil (“Olive Oil”) for an amount You will decide (“Solfeh Amount”), You will purchase from Solfeh the Olive Oil at a different certain amount (“Murabaha Amount”) and You will authorize Solfeh to sell the Olive Oil at Solfeh Amount.

You will receive the Solfeh Amount and You will pay the Murabaha Amount to Solfeh on equal installments.

You are committed to settle the Murabaha Amount to Solfeh on equal installments within 6, 12, 18 or 24 months as agreed with Solfeh.

You hereby authorize Solfeh to deduct each and all installments from your remuneration, salary, bonuses, allowances and rights or amounts due to You from Your employer. You are committed to sign and execute any necessary documents required by Solfeh to such effect.

User Agreements

In addition to these Terms & Conditions, in connection with Your use of the Service, You are subject to, and/or required to agree to, a commitment agreements, Murabaha agreements or similar agreements governing or relating to the Service (“User Agreements”).

You agree and acknowledge that Your hand signature is required for the User Agreements and Solfeh is released from any obligations if such User Agreements are not signed.

Employer & Employee

For the Service to be available for any User, such User’s company or employer must apply for the Service at the Website.

Employer or companies who wishes the Service to be available for their employees must apply through the Website and sign any required User Agreements. Employer or companies acknowledge that the non-signing of any required User Agreements will not enable their employees to apply for the Service through the Website. The employees of an employer or a company that applied for the Service and the signed the required User Agreements are qualified employees (“Qualified Employee(s)”).

Qualified Employees are eligible to apply for the Service through the Website. You acknowledge that being a Qualified Employee does not oblige Solfeh to provide you the Service. You acknowledge that being provided the Service previously by Solfeh, does not oblige Solfeh to provide the Service to You again.

The employees of an employer or a company that did not apply for the Service or did not sign the required User Agreements are non-qualified employees (“Non-Qualified Employee(s)”).

Non-Qualified Employees are not eligible to apply for the Service; however, they may apply for the Service but Solfeh is not obliged to accept their application. Once the employer or the company of such Non-Qualified Employee applies for the Service, such Non-Qualified Employees may be contacted by Solfeh and may become Qualified Employees.

You acknowledge that Solfeh is not obliged to provide the Service to You as a Qualified Employee even if the Service was provided to another Qualified Employee who is Your colleague at work.

Other Qualifications

In order to enroll in and use the Service, You will need your 10-digit National Identification Number, unless otherwise expressly agreed by Solfeh (provided Solfeh shall have no obligation to so agree). If you do not have such a number and are interested in enrolling in the Service, you must contact Solfeh Customer Service at …………………

Employer or companies who wishes the Service to be available for their employees must apply through the Website and sign any required User Agreements. Employer or companies acknowledge that the non-signing of any required User Agreements will not enable their employees to apply for the Service through the Website. The employees of an employer or a company that applied for the Service and the signed the required User Agreements are qualified employees (“Qualified Employee(s)”).

Qualified Employees are eligible to apply for the Service through the Website. You acknowledge that being a Qualified Employee does not oblige Solfeh to provide you the Service. You acknowledge that being provided the Service previously by Solfeh, does not oblige Solfeh to provide the Service to You again.

The employees of an employer or a company that did not apply for the Service or did not sign the required User Agreements are non-qualified employees (“Non-Qualified Employee(s)”).

Non-Qualified Employees are not eligible to apply for the Service; however, they may apply for the Service but Solfeh is not obliged to accept their application. Once the employer or the company of such Non-Qualified Employee applies for the Service, such Non-Qualified Employees may be contacted by Solfeh and may become Qualified Employees.

You acknowledge that Solfeh is not obliged to provide the Service to You as a Qualified Employee even if the Service was provided to another Qualified Employee who is Your colleague at work.

Profile

Profiles for Users will be created automatically by Solfeh upon applying for the Service.

You need to specify the Solfeh Amount and the payment period and the fill up the electronic application online which include Your personal information Your working information, Your address and Your mobile number.

Your application and profile creation will not be processed unless You verify and confirm Your mobile number by inserting the One-Time Password (“OTP”), We will send to Your mobile number. The OTP need to be inserted in the designated box at the Website within 30 Seconds.

Upon submitting the application online and the creation of Your profile, You will be able to use the Website and the Service by inserting Your Mobile number and inserting the OTP you will receive every time You decide to access Your profile. You agree not to share or disclose Your Mobile number and the OTP to any other person.

Therefore, Your username is Your mobile number and Your password will be an OTP that will You receive on Your mobile number every time You require to access the Website, Your profile and the Service. Please note that the OTP is generated by Solfeh and will be changed every time.

The successful submission of the application and the creation of Your profile by Solfeh, does not mean the acceptance of Your application for the Service.

Each User, Qualified Employee or Non-Qualified Employee shall complete the relevant application on the Website and provide a scanned copy of all required documents.

Solfeh reserve its right to scrutinize the authenticity of any provided documents by either requesting the original of such document or by confirming the authenticity of such document by the relevant authorities. You hereby authorize Solfeh before any relevant authority to check the authenticity of any provided document by You.

You acknowledge that You are solely responsible of all information provided especially Your mobile number and Your International Bank Account Number (“IBAN”). Solfeh will transfer the Solfeh Amount to the IBAN provided by You. You will be responsible to pay Solfeh the Murabaha Amount once the Solfeh Amount is transferred to the IBAN you provided regardless of whether such IBAN is Yours or not.

Confidentiality of Access Information

Use of the Service requires a computer or approved mobile device and Internet access connected through an Internet or mobile service provider and with a web browser (for example, Safari, Chrome, Firefox or Microsoft Internet Explorer).

To provide the highest degree of confidentiality and to protect the security of Your financial information, You must have an Internet browser that supports 128-bit encryption and secure sockets layer version 3.0 or higher. Use of the Service with lower than 128-bit encryption is strictly prohibited. To the extent You are able to access the Service using lower than 128-bit encryption, We specifically disclaim any and all responsibility for losses resulting from Your use of such lower encryption. We may change these requirements from time to time.

You agree to keep your username, password, password reminder question and answer and any other security or access information (collectively, (“Access Information”)) confidential to prevent unauthorized access to Your profile and to prevent unauthorized use of the Service. We recommend that You memorize Your Access Information and do not write it down. You agree not to give or make available Your Access Information to any unauthorized individual.

If You believe the security of Your password or any other Access Information has been compromised in any way (for example, your password has been lost or stolen, someone has attempted to use the Service under Your username without Your consent, Your profile has been accessed), You must notify Us immediately.

We reserve the right, under certain circumstances, to deny Your access to Your profile or to the Service or the Website, or to deny the processing of transactions, in order to maintain or restore security or performance the Website or any other Solfeh sites and systems. We may do so if We reasonably believe Your Access Information has been or may be obtained or is being used or may be used by an unauthorized person(s).

Content and Copyright

All materials, information, copyright, trademarks, patents and other intellectual property rights in any material or content (including without limitation software, data, applications, information, text, photographs, music, sound, videos, graphics, logos, symbols, artwork and other material or animated images) contained in or accessible via this Website (“Content”) is either owned by Solfeh or has been licensed to us by the legitimate owner(s) for use. Users of the Website may download or print one copy of any and all materials on the site for personal, non-commercial use, provided that they do not modify or alter the materials in any way, nor delete or change any copyright or trademark notice (“Legitimate Use”). However, nothing contained herein shall be construed to grant any rights in relation to such Content and in no event shall be used or copied in any way other than the Legitimate Use without obtaining the prior written consent of Solfeh. Moreover, You acknowledge and undertake NOT TO USE the Website or any part of it for any of the following:

All materials on this Website are provided for lawful purposes only. None of the information including the Content on this Website may be copied, distributed or transmitted in any way for commercial use without the prior written consent of Solfeh.

Solfeh reserves full ownership of and intellectual property rights on any material downloaded on the Website. Nothing on this Website should be construed as granting any right or license to any User not it shall be interpreted as a promise by Solfeh to contract. This Website, its Content, all product and Service names and designs referred to on this Website are copyright of Solfeh. All rights reserved, except for those marks which are expressly indicated as owned by other companies.

Communications

You agree to receive from Solfeh or our authorized agents, phone calls and text messages at any mobile or land line number You provide, including calls and messages made using an auto-dialer or pre-recorded message.

You agree that all electronic communications that We receive on the Website or otherwise in connection with the Service, such as those directing us to change Your IBAN, that match Access Information or other identity information you have provided when enrolling in or using the Service will be deemed valid, authentic and binding obligations. Pursuant to law and regulations, these electronic communications therefore will be given the same legal effect as Your written and signed paper communications, shall be considered a “writing” or “in writing” and shall be deemed for all purposes (i) to have been “signed” and (ii) to constitute an “original” when printed from electronic files or records established and maintained in the normal course of business.

You agree that electronic copies of communications are valid and You will not contest the validity or enforceability of such communications or any related transactions, absent proof of altered data or tampering, under the provisions of any applicable law relating to whether certain agreements are to be in writing or signed by the party to be bound thereby, and such copies shall be admissible if introduced as evidence on paper in any judicial, arbitration, mediation, or administrative proceeding to the same extent and under the same conditions as other business records originated and maintained in documentary form.

You agree (to the maximum extent permitted by law) to hold harmless Solfeh and protect and indemnify Solfeh from and against any and all claims, losses, liability, damages and/or demands (including, without limitation, reasonable attorneys’ fees and court costs) of any kind, direct or indirect, arising out of or in any way connected with any Service rendered by Solfeh pursuant to or in accordance with any and all electronic communications for which we have attempted to verify Your identity as set forth above.

By enrolling in the Website you agree that as a condition of using the Service you consent to receiving all transactional e-mail communications from Solfeh which are directly related to Your use of the Service and to any disclosures that may result from Solfeh sending profile communications to you via the e-mail address you provide.

BECAUSE E-MAIL IS NOT A SECURE METHOD OF COMMUNICATION OVER THE INTERNET, WE RECOMMEND YOU DO NOT SEND CONFIDENTIAL INFORMATION BY E-MAIL. PLEASE BE AWARE YOU CANNOT USE E-MAIL TO APPLY FOR THE SERVICE.

Fees and Charges

Except as provided herein, we do not at this time charge any enrolment fees, recurring usage fees or any other fees for Your use of the Service (including viewing Your profile information. However, we do charge fees in certain circumstances that may arise in connection with Your use of the Service (including a Returned Check Fee). In addition, You shall be subject to all fees, charges, penalties, balance requirements, and other restrictions explained in Your User Agreements or other additional agreements.

Notwithstanding the foregoing, fees are subject to change, and We may impose additional charges, penalties or fees in connection with Your use of the Service at any time, subject to the terms hereof.

You agree to promptly pay all fees and charges for service provided through the Service.

Changes In Service; Interruptions In Service

We may, from time to time and at any time, revise, update, discontinue or otherwise modify, temporarily or permanently, the Service or any part thereof (including, without limitation, the Website, these Terms & Conditions, and any materials related to the Service), or Your access thereto. We will attempt to provide prior notice of any such material changes (by posting a notice of such changes on the Website when you log in, and/or sending a notice to You at the address shown on Our records, providing a link to the notice, sending You a secure message, or by any other method as permitted by law), but cannot guarantee that such notice will be provided. Use of the Service after notice has been provided to You constitutes acceptance of such changes.

Third Party Contents and Links

The Content displayed on our Website may contain features or links to other third-party websites or pages, which are completely unrelated to and independent of Solfeh may be subjected to different agreement and other terms. In addition to this, Google, Inc., Apple Inc., and/or their applicable international subsidiaries and affiliates will be third-party to this contract if you access our Website using applications developed for Apple iOS or Android-powered mobile devices, respectively. These third-party are not parties to these Terms & Conditions and are not responsible for the provision or support of our Website in any manner. Your access to our Website using these services or applications is subject to terms set forth in the applicable third party’s terms of service. Therefore, Solfeh makes no warranties or guarantees as the accuracy and authenticity of the content information provided by any third party and shall not be liable or responsible for any loss, damages of any kind or otherwise you may endure for accessing or using any third-party websites or contents.

Your Responsibilities and Liabilities

It is Your sole responsibility to ensure that the contact information in Your profile is current and accurate. This contact information includes, but is not limited to, name, address, phone numbers, e-mail addresses, and account numbers.

You are responsible for notifying Us of any changes to Your e-mail, mobile device, mobile number and telephone contacts.

We are not responsible for any payment processing errors or fees incurred by You if You do not provide accurate account or contact information.

Data Recording

When You contact us, the communication or the information You provide may be recorded or otherwise retained by Us or Our service provider. You consent to such recording or other retention. Without limiting the foregoing, You agree that We may record the conversations Our employees have with You or Your agents. We do this from time to time to monitor the quality of service and accuracy of information Our employees give You.

No Waiver

We shall not be deemed to have waived any of Our rights or remedies hereunder unless such waiver is in writing and signed by Us. No delay or omission on Our part in exercising any right or remedy shall operate as a waiver of that right or remedy or any other rights or remedies. A waiver on any particular occasion shall not be construed as a bar or waiver of any rights or remedies on future occasions.

Liability for Loss or Erroneous Data

Unless otherwise agreed by Solfeh, the Service is solely offered to citizens of the Hashemite Kingdom of Jordan.

Collection Expenses

If We have to file a lawsuit to collect whatever You owe us, You will pay Our reasonable expenses, including attorneys’ fees and court costs as allowed by law.

Governing Law

These Terms & Conditions are governed by and interpreted in accordance with all applicable Jordanian laws and regulations.
